1. General Information
These General Terms and Conditions (GTC) apply to all legal relationships between Business Ontime GmbH, Am Zimmersteig 2, 08606 Oelsnitz, Germany (hereinafter "Homecheckberlin.de" or "we") and its clients. The contract language is English.

2. Conclusion of a Contract
The presentation of our services on the website www.homecheckberlin.de does not constitute a legally binding offer, but rather a non-binding invitation to clients to request our services.

A contract is formed only when the client accepts our written offer (e.g., via email). The client will receive an order confirmation by email. With this confirmation, the client receives the contract text, these GTC, and our privacy policy.

3. Right of Withdrawal for Consumers
Clients who are consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

However, the right to withdraw expires if we have begun the execution of the service with the client's express prior consent and their acknowledgment that they will lose their right to withdraw once the service has been fully performed.

4. Prices, Payment, and Due Date
Homecheckberlin.de is entitled to payment of an agreed fee. The prices are fixed and agreed upon before the contract is concluded. The client will always receive an invoice.

The service is provided after advance payment, either by bank transfer or PayPal. Invoices are due immediately and payable within 8 days.

If the client is a business and falls into payment default, Homecheckberlin.de is entitled to claim default interest at a rate of 9 percentage points above the base interest rate.

5. Duties of Homecheckberlin.de
The inspection will be carried out independently, impartially, and conscientiously. Homecheckberlin.de is entitled to use assistants or third parties to perform the contract; the contractual partner of the client remains Homecheckberlin.de.

Upon completion of the order and payment of the fee, documents provided by the client for the inspection will be returned. We are entitled to keep copies for our records.

6. Appointment Cancellation
The parties agree on an appointment for the on-site inspection. If the client cannot attend, they must cancel it at least 24 hours in advance by email. In case of a later cancellation, Homecheckberlin.de is entitled to claim compensation for costs of 150 €. The client reserves the right to prove that Homecheckberlin.de incurred no damage or significantly less damage.

7. Client's Cooperation Duties
The client is obliged to provide us with all information and documents necessary for the performance of the service. This includes, but is not limited to, known defects, renovation history, and any relevant plans.

Homecheckberlin.de will assume that any unreported and non-obvious defects or special circumstances do not exist unless they are made known to us by the client.

If the client does not fulfill their cooperation duties in time, Homecheckberlin.de is not responsible for any resulting delays or limitations in the service.

8. Secrecy
Both parties undertake to maintain strict confidentiality regarding all business-related information learned during the cooperation, even after its termination.

9. Liability of Homecheckberlin.de
Homecheckberlin.de provides its services with professional diligence. However, our liability is limited as follows:

• We assume unlimited liability for intent and gross negligence.

• For simple negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations); the amount of compensation is limited to the typically foreseeable damage.

• Liability for indirect damages is excluded.

• These limitations of liability do not apply in cases of injury to life, body, or health.

All claims for damages against Homecheckberlin.de in commercial transactions become time-barred one year after the service was provided.

10. Data Protection
Homecheckberlin.de collects and processes personal data in accordance with our Privacy Policy and the applicable data protection regulations, in particular the GDPR.

11. Final Provisions
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

For clients who are not consumers, the place of jurisdiction for all disputes is the registered office of Business Ontime GmbH in Oelsnitz.
